Personal Represenative Duties….Learn them and sleep well

As an attorney who has settled hundreds of estate over the years I can give some important advice for people who are named the executor under a will. The most important thing to learn is the Personal Representative duties and responsibilities.  Most people don’t realize that when the are a personal representative of an estate they  are a legal responsible fiduciary and the action they take and don’t take and this can get them in a lot of trouble.  I have seen many times in my career that one family member sue the personal representative (sometimes the motivation is out of jealously) but the fact of the matter is that the behavior of a personal representative duties is govern by state probate law and courts. Courts are not very forgiving and they expect people to hire attorneys when they are name as a personal representative. So learn the personal represenative duties and sleep well at night.
