Personal Represenative Duties….Learn them and sleep well

As an attorney who has settled hundreds of estate over the years I can give some important advice for people who are named the executor under a will. The most important thing to learn is the Personal Representative duties and responsibilities.  Most people don’t realize that when the are a personal representative of an estate they  are a legal responsible fiduciary and the action they take and don’t take and this can get them in a lot of trouble.  I have seen many times in my career that one family member sue the personal representative (sometimes the motivation is out of jealously) but the fact of the matter is that the behavior of a personal representative duties is govern by state probate law and courts. Courts are not very forgiving and they expect people to hire attorneys when they are name as a personal representative. So learn the personal represenative duties and sleep well at night.

There are so many websites offering advise for many different types of situations. This can be a frustrating time in anyone’s life and can sometimes be terrible to deal with. Sometimes lawyers and attorneys cannot represent you fairly, so you want to make sure you are well educated and informed about the processes you are dealing with. Charging a commission to the talent

Some agencies double-end their fee by charging a commission to the talent based on their fee and a mark-up to the client on top of the gross fee.

Talent discounted fee = $350 (normally $500)

Add Mark-up = $150

Fee charged to the client = $500 plus mark-up = $650

Using this method, the agency earns a profit of $300, double the commission of most of the other methods. While tempting, this double-dipping method is extremely uncool and unfair and I, Randy Charach from Synergy Talent, do not recommend it.  There are better ways to improve profitability without being greedy.  Remember that taking an ethical approach to your business dealings can only help your credibility and reputation among talents and clients.

What should I study?

I want to get a GED, but I am not sure what I need to study to prepare for the test. Are there websites that give you information on what you need to study? Or are there books I can buy that include practice tests? I really want to find practice tests that I can take so I have an idea what I need to study. Is the GED test really hard? I want to be able to go back to school to learn a trade, I just don’t make enough money right now to support my family, but I can’t do anything until I get a GED.

Hoping I Wouldn’t Make a Mistake

When I was made the executor of an estate, I hoped that I would figure out what I was doing. I really cared about this person. I didn’t know much at all about the probate process. I hoped that I would select a good attorney. I hoped that someone would tell me how to prepare for your first probate attorney visit. I hoped that I would find everything that I would need. I hoped that someone would help you deal with all the extra emotions that you feel. I hoped that I wouldn’t make a mistake. I hoped that I wouldn’t upset anyone. I hoped that I wouldn’t let anyone down.

Keeping Busy Doing Volunteer Work

On many of the long deployments that my husband gets sent to, I am always trying to fill my time here at home. This deployment I got together with another wife whose husband was also deployed. She is from Thailand and she was going to go home for 6 months while the men were gone. I decided to look into being a volunteer abroad in Asia so that maybe I could leave the country for 6 months as well. I had the wonderful opportunity to help teach English to some Buddhist monks in Thailand. What a great experience and a lovely way to give back while my husband was so busy.

ERP Evaluation Is Important

Companies who make use of ERP and has already integrated it into their system should have ERP Evaluation yearly.  This is important so management knows where processes have improved, what areas.  And if there are no improvements in specific areas,  they could evaluate what could have happened and what’s the reason for the failure.  That is where we failed before with the software that we bought because we did not evaluate the software even if all the systems were not working.  

Evaluations are important not just in business but in our way of life.  We should evaluate all of our actions and see if there would be consequences because regrets always happen in the end.
